The court's directive comes in response to findings from a Government Order (G.O.) that revealed procedural violations in a major procurement tender floated by Aavin between 2018 and 2020. The officers allegedly facilitated the award of a contract to a technically unqualified firm for the supply of 75 crore milk sachets, despite the firm lacking the necessary infrastructure and experience.

The Tamil Nadu Cooperative Milk Producers’ Federation placed an order without approval from the Empowered Committee or the State Tender Committee, both of which are mandatory for contracts of such scale. The court observed that public interest was compromised, and due diligence was bypassed, resulting in undue favouritism toward a specific vendor.

Despite an internal audit not detecting fraud, the court held that the absence of proper vetting and procedural compliance was enough to establish administrative misconduct. The court directed disciplinary action, including suspension and criminal investigation, stressing that seniority or retirement should not shield officials from legal accountability.
